The purpose of this note is to summaries the recent judgment of the Supreme Court, analyzing the validity of the Aadhaar act. In the process we will be able to better visualize its impact of this order on the current system, and the modifications that are needed in the Aadhaar act to align it with the SC order.
The Context
The first attempt to give the Aadhaar program a legislative cover was made in 3rd Dec 2010, when the National Identification Authority of India Bill, 2010 was introduced in the Rajya Sabha, but it never got through, till it was later reintroduced in the lok Sabha on the year 2016 as a Money Bill. The Bill received the assent of the President on 25th March 2016, thereby becoming an Act (18 of 2016).
