Recently, the committee under the chairmanship of Justice Srikrishna came out with an report aimed at protecting privacy of Indian citizens using services offered over the internet. This report is important, as it could potentially become a guiding document for all agencies entrusted with the task of framing rules governing this subject. What I plan to do in this note is to summaries the key aspects of this report for enabling easy reference.
Need (Law)
a) India cannot fully emulate the laws governing privacy of other jurisdictions as it needs and motivation are different. b) The current SPD (sensitive personal data or information rules under section 43Aof IT Act aimed at securing sensitive data) hasn’t been very effective since these can be overridden by a contract, thereby justifying a new law to govern individual’s privacy.
